WHAT WILL IT DO?

Replace California’s cash bail system with a new “pretrial release system” that would make a determination to release suspects based on a suspects’ calculated public safety and flight risk

CONTEXT:

Bail is money deposited to guarantee the prisoner’s appearance in criminal court on a later date and is refunded upon appearance in court. Bail price is set based on the seriousness of the crime and the individual’s criminal history.

In California, a bail bond generally costs 10%, which is mandated by law and set by the California Department of Insurance. The bail fee, or premium, is a non-refundable percentage of the total amount of the bail, the bail bondsman will put up the remainder of the bail on the suspects behalf.

ARGUMENTS FOR:

The money bail system wastes millions in tax dollars by unfairly forcing people who can’t afford their bail to wait in jail for their day in court. Basing freedom in wealth is inherently discriminatory and should instead focus on safety and justice for all.

ARGUMENTS AGAINST:

Many believe bail reform is necessary but there are arguments that these high medium and low risk classifications should not be made based on a computer algorithm. As proven in mortgage and business loan assessments, computer generated metrics can easily discriminate against the poor, minorities and people who live in certain neighborhoods. This is not the solution for bail reform.
